"SOVEREIGNTY BY THE BARREL"
Turtle Mountain Band Of Chippewa - North Dakota
"What is happening in western North Dakota is a travesty for all Indian people.  I feel proud that we are taking this stand."
Tribal Chairman Richard McCloud concluded, "In the future, water will be worth more than oil.
We need to protect our water here in the Turtle Mountains for our kids and grandkids."

The tribe became one of the first tribes in the nation to ban 'fracking' within their territories and backed up that ban
with a new tribal law in place. The new tribal law states that hydraulic fracturing or any other process that is toxic
is prohibited in perpetuity and this includes the lands enjoining the Little Shell Valley Aquifer,
which are not part of the reservation, but which are the tribe's main source of fresh water.

SOVEREIGNTY BY THE BARREL

The Turtle Mountain Chippewa became the first tribe in the United States to ban hydraulic fracturing (fracking) on November 22, 2011,
By unanimous vote for a tribal resolution drafted by the grassroots tribal member group No Fracking Way Turtle Mountain Tribe.
The tribal resolution fracking ban was amended by the tribal council to direct the Bureau of Indian Affairs (BIA) to cancel oil and gas bids
On 45,000 acres of tribal land that was scheduled to begin on December 14, 2011.The BIA cancelled the bids on December 9, 2011.

Federal regulators thus far have exempted the chemical fluids used in offshore fracking from the nation's clean water laws,
allowing companies to release fracking fluid into the sea

without filing a separate  environmental impact report or statement looking at the possible effects.
That exemption was affirmed this year by the U.S. Environmental Protection Agency, according to the internal emails reviewed by the AP.

Biocides
Return To Top Of Page

Biocide can also refer to the destruction of life, a form of omnicide that affects every living thing, not just humans;
one who wishes that everything in the entire world, or universe, face extinction, is labeled a 'Biocidist', or having 'biocidal' ideologies.
Because biocides are intended to kill living organisms, many biocidal products pose significant risk to human health and welfare.
In case it flies over your head, humans are water based living organsims.
Think about it this way, that oil and natural gas down there hasnt seen the light of day in millions of years.
It to was a living organisim, now it is decomposed, rotten per se.

If you send down fresh water with living organisms, it will set off a rott fest, turning the well sour, even plugging it.
So you kill all living organisms in the water before the frack.

The problem is during frack application biocides get spilt, and during flow back of the well, cocktail water coming back up is getting spilt,
and the need to dispose of the flow back water by injecting it back into the earth at disposal wells. Read More Below.
No, no one keeps enough biocides around the house to treat 3 million gallons of water
Not only that with no disclosure, no one knows the strength they frack with.

No, Fracking has been around a long time, But chemicals were controlled until 2005.
Never has it been done at this pace with no control.
In 2012, the U.S. completed 45,468 oil and gas wells and brought online 28,354 of them.
Compared with 3,921 wells completed in the rest of the world"
In 2005, the oil and gas industry was granted an exemption from the Safe Drinking Water Act,
Allowing the injection of toxic fluids directly into groundwater without oversight by the U.S. Environmental Protection Agency (EPA).
So when you read or hear how fracking has been used safely for years and years,  thats not quite correct.

Haliburton Loophole - 2005

Ohio Fact Sheet
A Lot Of Dirty Water
56 Million Barrels A Day

This is the part about fracking that never gets completed in the news stories.
Yes injecting the cocktail into the well bore that we wish to produce is a couple of miles
in the earth.
Be awhile if that ever comes back to the surface through formations. Thing is after the frack is completed you are going to get flow back of the cocktail water.

Lets say 50% comes back to the surface. Lets say you pumped down 3 million gallons of cocktail water.  1.5 million gallons are coming back.
Convert the gallons to barrels. 42 gallons in a barrel is 35714 barrels. A truck can haul 90 to a 100 barrels of heavy water legally. (Fresh water weighs less, isnt contaminated)
So you load up 360 trucks of cocktail water and haul it down the road to a disposal well and pump it back into the earth to get rid of it.
In North Dakota its going down into the dakota formation. 5000 to 6000 feet down. Roughly 2500 feet under known fresh ground water.
And no were not putting it back in the formation where we used it, it would just keep coming back up during production of the hydrocarbon well.
Mankind has never done this before on this scale.

Good 3-d imageing starting on page 22.
Why page 3 is needed is an insult to the following,  safety, the concern of no cocktail disclosure, women and children, the battle of alcoholism.
Wouldnt everyone want to have clean water, and to teach children moderation in all aspects.
Yes you will find these chemicals in household products. But not at the rate of 3 million gallons (450 to 500 truckloads) and no disclosure.
Were talking about extracting tight oil, not cleaning your toliet or doing dishes.

USGS ND Water Study
Return To Top Of Page

This all means that there are sighs of relief from home-(and well-) owners.
But this toe-in-the-water approach is obviously inadequate as USGS researcher Rod Caldwell, from Helena, Montana makes obvious.
A clever USGS calculation of horizontal groundwater movement estimates that any contamination would still be 0.5 km (0.35 miles)
away from any of the potential leak zones, which were at least 4.6km from a domestic well!
Well done to all concerned, because this small sample will only be the start of what will prove to be a mammoth task.
The median distance to the nearest oil and gas well was 4.6 km. That Is 2.85 Miles
A Sigh Of Relief

Abstract

The quality and age of shallow groundwater in the Bakken Formation production area were characterized using data from 30 randomly distributed
domestic wells screened in the upper Fort Union Formation. Comparison of inorganic and organic chemical concentrations to health based drinking-water
standards, correlation analysis of concentrations with oil and gas well locations, and isotopic data give no indication that energy-development activities
affected groundwater quality . It is important, however, to consider these results in the context of groundwater age. Most samples were recharged before the
early 1950s and had C ages ranging from <1000 to >30,000 years. Thus, domestic wells may not be as well suited for detecting contamination
associated with recent surface spills as shallower wells screened near the water table. Old groundwater could be contaminated directly by recent subsurface
leaks from imperfectly cemented  oil and gas wells, but horizontal groundwater velocities calculated from C ages imply that the contaminants would still be less
than 0.5 km from their source . For the wells sampled in this study, the median distance to the nearest oil and gas well was 4.6 km.
Because of the slow velocities, a long-term commitment to groundwater monitoring in the upper Fort Union Formation is needed to assess the
effects of energy development on groundwater quality. In conjunction with that effort, monitoring could be done closer to energy-development
activities to increase the likelihood of early detection of groundwater contamination if it did occur.
The median distance to the nearest oil and gas well was 4.6 km. That Is 2.85 Miles
